A Clark County judge on Monday, November 2 kept voter protections in place at the Desert Breeze Community Center vote center in southwest Las Vegas and extended them through Election Day, Tuesday, November 3. District Judge Joe Hardy extended the temporary restraining order he first issued at the end of early voting, after the ACLU of Nevada filed a complaint alleging a pattern of voter intimidation outside the center at 8275 Spring Mountain Road.

What the order requires

County election officials must treat the narrow walkway between the parking lot and the voting area as the entrance to the vote center. No electioneering is allowed on that walkway or within 100 feet of it. The walkway is about 15 feet wide and is the single path voters use to reach the voting area, according to the earlier court order reported by News 3.

The order also bars a woman who had been using a bullhorn near the site from harassing or intimidating voters, following voters while recording them, talking to voters as they go in or out, or threatening or assaulting anyone, KTNV reported. Video of her yelling through the bullhorn outside the polling place spread widely online, the Las Vegas Review-Journal reported. The people covered by the order are listed in the case only as Jane Does 1 to 3, and no one has been publicly identified by name.

What the ACLU alleged

The ACLU complaint alleges that people outside the center blocked the pathway, followed and filmed voters, made threats and, in one case, assaulted a voter with a disability. The ACLU says voters faced vulgar insults as they walked in and found the only path to the entrance obstructed. Those are allegations in a civil complaint, and they have not been decided in court.

A Clark County spokesperson said the county has worked to manage crowding at the site, has said it will comply with the order, and said the public should continue to feel safe exercising their right to vote.

What it means on Election Day

Polls are open 7 a.m. to 7 p.m. Tuesday at Clark County vote centers, and voters can cast a ballot at any of them, Desert Breeze included. Anyone who sees intimidation at a polling place can tell a poll worker or call the Clark County Election Department at 702-455-VOTE (8683). Voters should call 911 if someone is in danger.

The case is ACLU of Nevada v. Clark County, case A-26-960658-C in Clark County District Court. Hardy signed the first order on Thursday night, October 29, and it covered Friday, October 30, the last day of in person early voting. Monday's extension keeps the same protections in force until polls close on Tuesday.
